Agreement to these terms

By downloading, installing, or using Kaloqa ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

These terms constitute a legal agreement between you and Kronologix LLC ("we," "us," or "our"), the operator of Kaloqa.

What Kaloqa is

Kaloqa is a local discovery service that provides curated place recommendations — restaurants, coffee shops, bars, experiences — for cities in the United States. Recommendations are based on a combination of editorial curation, community input, and real-time context.

Kaloqa is not a review platform, a reservation service, or a directory. We make no guarantee that any recommended place will be open, available, or meet your expectations on any given visit.

Your account

To access certain features (saving your Journey, favoriting places, submitting tips), you must create an account using your email address.

You are responsible for:

  • Keeping your account credentials secure
  • Any activity that occurs under your account
  • Providing accurate information, including an honest confirmation of your age if you access the drinks category

You must be at least 18 years old to use Kaloqa. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. The drinks discovery feature additionally requires you to confirm you are at least 21 years old (United States legal drinking age); by tapping "I'm 21 or older," you confirm this under the honor system. Kronologix LLC does not independently verify age, does not sell alcohol, and accepts no responsibility for alcohol consumption or access to licensed premises. We provide this acknowledgment as a good-faith measure only.

We may suspend or terminate your account if we believe you have violated these terms, provided false information, or engaged in behavior that harms other users or the integrity of the service.

Acceptable use

You may use Kaloqa for your personal, non-commercial use. You agree not to:

  • Use the App in any way that violates applicable law or regulation
  • Submit false, misleading, or harmful content as feedback or tips
  • Attempt to access, tamper with, or disrupt systems or infrastructure powering the App
  • Scrape, copy, or redistribute content from the App without written permission
  • Impersonate any person or entity
  • Use the App to harass, harm, or discriminate against any individual

We reserve the right to remove any content you submit and to terminate your access if you violate these terms.

Content you submit

When you submit feedback, tips, photos, or other content through Kaloqa ("User Content"), you retain ownership of it. You grant us a non-exclusive, royalty-free, worldwide, sublicensable (solely to the service providers and vendors listed in our Privacy Policy's "Who we share your information with" section), and transferable license to host, store, reproduce, modify, resize, adapt, distribute, and publicly display that User Content in order to operate, promote, and improve Kaloqa.

This license for any specific piece of User Content ends when you delete that content or your account — except that a raw tip already incorporated into a place's synthesized, non-attributed description may remain as anonymized system content, since it no longer identifies you.

You represent that content you submit is accurate to the best of your knowledge, does not infringe any third-party rights, and does not violate any law.

Our content and intellectual property

Except for User Content and third-party materials identified in these Terms, all content in Kaloqa — including place descriptions, editorial copy, app design, and branding — is owned by or licensed to us. You may not reproduce, distribute, or create derivative works from our content without written permission.

Kaloqa incorporates place data, photos, and ratings provided by Google. Your use of that content is subject to the Google Terms of Service and Google Privacy Policy, and you agree to comply with Google's applicable platform policies and attribution requirements.

Place recommendations

Place recommendations in Kaloqa are editorial in nature and are not guarantees. We make reasonable efforts to verify that places are accurate, open, and worth visiting — but:

  • Hours, prices, and availability change
  • We are not responsible if a place is closed, full, or different from its description
  • We are not responsible for any experience you have at a recommended place

If you find a place is permanently closed or significantly misrepresented, please report it using the flag feature in the App. Reports help us prioritize which places to check and correct.

Disclaimer of warranties

Kaloqa is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy or completeness of any place information.

Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Kaloqa — including but not limited to loss of data or loss of revenue. Nothing in these Terms limits or excludes our liability for gross negligence, willful misconduct, fraud, or any other liability that cannot be limited or excluded under applicable law.

Our total liability to you for any claim arising from these terms or your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim (which may be zero, as the App is currently free).

Some jurisdictions do not allow limitation of liability for certain types of damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

If any part of this limitation of liability is found invalid or unenforceable by a court, the remaining parts will still apply to the fullest extent permitted by law.

Indemnification

You agree to indemnify and hold us harmless from any third-party claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of applicable law, or your infringement of any third-party rights — except to the extent such claims arise from our own negligence or misconduct.

Third-party services

Kaloqa relies on third-party services to operate — see the full, current list in our Privacy Policy's "Who we share your information with" section, so this list doesn't drift out of sync as those services change. Your use of features powered by these services is subject to their respective terms of service. We are not responsible for the practices of third-party providers.

Termination

We may terminate or suspend your access to the App at any time, with or without notice, for any reason including violation of these terms. You may stop using the App at any time. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

Changes to these terms

We may update these Terms of Service at any time. When we do, we will update the "Last updated" date above. Your continued use of the App after changes are posted constitutes your acceptance of the revised terms. If we make material changes, we will make reasonable efforts to notify you (e.g., via in-app notice or email).

Governing law

These terms are governed by the laws of the State of Washington, United States, without regard to its conflict of law principles. Any legal action or proceeding arising from these terms or your use of the App must be brought exclusively in the state courts of Washington located in Snohomish County, or the United States District Court for the Western District of Washington. You irrevocably consent to the personal jurisdiction and venue of these courts, except that either party may bring an individual action in a qualified small claims court.
